2. Acceptance of Terms

By accessing and using TrackyFy services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our services.

3. Service Description

TrackyFy provides gym management software solutions including:

Member management and tracking
Payment processing and gateway integration
Analytics and business reporting
Automated workflows and notifications
Optional biometric attendance hardware

4. User Responsibilities

Provide accurate and complete information during registration
Maintain the confidentiality of your account credentials
Use the service in compliance with applicable laws and regulations
Not engage in any unauthorized or illegal activities
Ensure proper handling of member data and privacy

5. Payment Terms

All prices are listed in Indian Rupees (INR)
Subscription fees are billed in advance
Payment is due immediately upon subscription activation
Late payments may result in service suspension
Biometric hardware (if purchased) is billed separately

Onboarding & KYC Requirements

6. Payment Gateway Onboarding

To enable payment collection features through TrackyFy, you must complete the Razorpay payment gateway onboarding process. This is mandatory for accepting payments from your gym members.

7. Required Documents for KYC Verification

During the onboarding process, you will be required to provide:

Aadhaar Card: Valid Aadhaar number and document for identity verification
PAN Card: Permanent Account Number for tax compliance
Bank Account Details: Account number, IFSC code, and account holder name
Business Documents: GST certificate (if applicable), business registration proof
OTP Verification: Mobile number linked to Aadhaar for OTP authentication

8. Verification Process

The Razorpay KYC verification process involves:

Creating a Razorpay merchant account through TrackyFy platform
Uploading required identity documents (Aadhaar, PAN)
Entering and verifying bank account details
OTP verification via mobile number registered with Aadhaar
Razorpay compliance team review (typically 24-48 hours)
Account activation and payment collection capability

9. OTP and Authentication

Multiple OTP verifications may be requested during onboarding:

Aadhaar verification OTP
Bank account verification OTP
Mobile number verification OTP
Email verification OTP

Important: Ensure you have access to the mobile number linked with your Aadhaar and bank account for seamless verification.

10. Data Usage for KYC

The documents and information collected during KYC are:

Securely transmitted to Razorpay for verification
Used solely for compliance with RBI and payment regulations
Stored in encrypted format as per data protection laws
Not shared with any third parties except regulatory authorities if required

11. Onboarding Timeline

Document Submission: 10-15 minutes
Verification Process: 24-48 hours (Razorpay review)
Account Activation: Instant after approval
Total Time: 1-3 business days

Important Notice

You can use all TrackyFy features immediately except payment collection. Payment acceptance will be enabled only after successful completion of Razorpay KYC verification. Please complete the onboarding process at your earliest convenience.

12. Intellectual Property

All content, features, and functionality of TrackyFy are owned by TRACKYVERSE TECHNOLOGIES PRIVATE LIMITED and are protected by international copyright, trademark, and other intellectual property laws.

13. Data Privacy & Protection

By using TrackyFy, you acknowledge that:

You will handle member data responsibly and in compliance with applicable laws
KYC documents will be securely processed through authorized payment partners
You consent to data processing as outlined in our Privacy Policy
Biometric data (if applicable) will be stored securely and used only for attendance purposes

14. Hardware Terms (Biometric Devices)

If you have purchased biometric hardware:

Delivery will be completed within 7-10 business days
Devices come with 1-year manufacturer warranty
Installation support is provided remotely or on-site (charges may apply)
Device replacement due to mishandling is not covered under warranty
Return policy does not apply to biometric hardware once installed

15. Limitation of Liability

TrackyFy shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Delays in payment gateway onboarding due to incomplete KYC documents
Shipping delays caused by courier services or force majeure events
Data loss due to user negligence or unauthorized access

16. Service Suspension & Termination

We reserve the right to suspend or terminate services if:

KYC verification fails or fraudulent documents are submitted
Payment dues are not cleared within stipulated time
Terms & Conditions are violated
Illegal activities are conducted using the platform

17. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bihar, India.

18. Changes to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be communicated via email, and continued use of the service constitutes acceptance of updated terms.
